Article 1 - Purpose of the Terms of Use
These Terms of Use set out the terms and conditions governing access to the website www.travellersocks.com and the use of its features by any User, whether a visitor or a Consumer.
These Terms of Use govern, in particular: access to the Website, browsing, Account creation and management, any content or reviews published by Users, the rights and responsibilities of the Website Publisher and Users, and the rules relating to intellectual property and personal data protection.
These Terms of Use were originally drafted in French. In the event of any translation, the French version shall prevail.
These Terms of Use are separate from and complementary to the Terms and Conditions of Sale, which govern the contractual terms applicable to orders placed on the Website.
Article 2 - Legal Notice and Definition of the Parties
2.1 Website Publisher
The Website www.travellersocks.com is published by TRAVELLER SOCKS, a French simplified joint-stock company (société par actions simplifiée) with share capital of EUR 5,000, registered with the Paris Trade and Companies Register under number 107 043 572, whose registered office is located at 23 rue de Lisbonne, 75008 Paris, France. The Publication Director is Vincent Tamagno, President of Traveller Socks.
2.2 Hosting Provider

2.3 Definitions
For the purposes of these Terms of Use:
• "Website": the website accessible at www.travellersocks.com, together with all of its subdomains, pages and content.
• "Publisher": the company identified in Article 2.1, which is responsible for the Website's editorial content and acts as the e-commerce service provider.
• "User": any person who accesses the Website, whether as a visitor or a Consumer, with or without creating an Account.
• "Consumer": any natural person acting for purposes outside their commercial, industrial, craft, self-employed professional or agricultural activity.
• "Account": the User's personal area on the Website, created following registration and enabling the User to manage their information and orders.
• "Terms and Conditions of Sale": the terms and conditions of sale applicable to Consumers for orders placed on the Website.
Article 3 - Acceptance and Amendment of the Terms of Use
Access to and use of the Website imply the User's full and unconditional acceptance of these Terms of Use. Where Account creation is available, the User indicates their agreement by ticking the dedicated acceptance box.
The applicable Terms of Use are those in force at the time the User browses the Website. The Publisher reserves the right to amend these Terms of Use at any time, in particular to take account of changes to the Website, legislation or case law.
If the Terms of Use are materially amended, any User who has an Account will be informed by any appropriate means, such as an information banner, notification or email. Continued use of the Website after such notice constitutes acceptance of the amended Terms of Use.
Article 4 - Access to the Website, Availability and Security
4.1 Access to the Website
The Website is accessible free of charge to any User with internet access. All costs associated with accessing the Website, including computer equipment, internet connection and software, are borne exclusively by the User.
The Publisher uses its best efforts to keep the Website accessible at all times, subject to maintenance operations, updates, force majeure events and technical difficulties beyond its control.
4.2 Availability and Service Interruptions
The Publisher does not warrant that the Website will operate without interruption or error. It may temporarily suspend access to the Website, without prior notice, for technical, maintenance or security reasons.
The Publisher shall not be liable for any loss or damage resulting from:
• the unavailability of the Website or all or part of its features;
• a temporary difficulty in or inability to access the Website caused by the internet network or the User's equipment;
• an intrusion, virus or malicious software attributable to the User or a third party.
4.3 Security
The Publisher implements reasonable measures intended to ensure the security of the Website and the data exchanged, in accordance with current industry standards and the obligations arising from the GDPR. However, the User acknowledges that absolute security on the internet cannot be guaranteed.
The User is responsible for taking all appropriate measures to protect their own equipment and data, including by using antivirus software and carrying out regular backups.
Article 5 - Account Creation, Management and Deletion
5.1 Account Creation
Access to certain Website features, such as order tracking, purchase history and management of delivery information, may require the creation of a User Account.
To create an Account, the User must provide accurate, complete and current information and undertakes to update it whenever it changes.
Account creation is reserved for natural persons who are of legal age and have legal capacity.
5.2 Login Credentials and Passwords
Login credentials, including the email address, username and password, are strictly personal and confidential. The User undertakes not to disclose them to third parties and to take all necessary measures to preserve their confidentiality.
Any login to the Account and any action taken through the Account are presumed to have been carried out by the User. If their credentials are lost, stolen or used fraudulently, the User must immediately notify the Publisher at service.customers@travellersocks.com, so that the Publisher may take appropriate measures, such as resetting the credentials or suspending the Account.
5.3 Account Suspension and Deletion
The User may request deletion of their Account at any time by contacting the Publisher or using the dedicated feature, subject to the processing of any current orders and the legal obligations requiring certain data to be retained.
The Publisher reserves the right to suspend or delete an Account, without prior notice or compensation, in the event of:
• a breach of these Terms of Use or the applicable Terms and Conditions of Sale;
• identity theft or the provision of false information;
• fraudulent use of the Website or the Account;
• manifestly unlawful conduct or conduct that infringes the rights of the Publisher, another User or a third party.
Suspension or deletion of the Account does not prevent the Publisher from claiming damages in respect of any loss suffered.
Article 6 - User Obligations and Liability
6.1 General User Obligations
The User undertakes to use the Website in compliance with applicable laws and regulations, public policy, accepted standards of decency and third-party rights.
In particular, the User must not:
• undermine public policy, public safety or human dignity;
• disseminate unlawful content, including content of a defamatory, insulting, hateful, racist, xenophobic, discriminatory, terrorist or child-pornographic nature, or content that incites violence;
• infringe the intellectual property rights of the Publisher or third parties, including copyright, trademarks, designs and database rights;
• attempt to circumvent technical protection measures implemented on the Website;
• disrupt the operation of the Website, in particular by using software, scripts, robots or other devices intended to hinder or distort its operation;
• fraudulently collect information or data available on the Website, including the personal data of other Users.
6.2 Accuracy of Information Provided
The User warrants that the information they provide is accurate, genuine and current, in particular when creating an Account or placing an order, including their contact details, delivery addresses and billing information.
The User is solely responsible for the consequences of any inaccurate information or failure to keep such information sufficiently up to date.
6.3 User Liability for Content
Where the Website allows the User to publish content, such as reviews, comments, photographs or other contributions, the User remains solely responsible for the content they publish.
The User warrants to the Publisher that they hold all rights required in relation to such content, including copyright and image rights, and undertakes to ensure that the content does not infringe any third-party rights.
Article 7 - User-Published Content and Moderation
7.1 User Reviews and Contributions
The Website may allow Users to publish product reviews or comments and, where applicable, content such as text and photographs in designated areas.
Reviews and contributions must relate to the User's genuine experience with the Website's products or services and must comply with the rules set out in these Terms of Use.
7.2 Moderation and Right of Removal
The Publisher is not required to carry out general monitoring of content published by Users, but may implement prior or subsequent moderation, whether manual or automated.
The Publisher reserves the right to refuse, modify or delete, at any time and without prior notice, any User content that:
• breaches these Terms of Use, the Terms and Conditions of Sale, the law or third-party rights;
• is manifestly unlawful or inappropriate;
• contains sensitive personal data or confidential information;
• is unrelated to the products offered on the Website.
In accordance with the liability regime applicable to hosting providers and publishers, the Publisher may be required to promptly remove manifestly unlawful content that is notified to it in accordance with the conditions prescribed by law.
7.3 Reporting Unlawful Content
Any User may report to the Publisher content that is manifestly unlawful or contrary to these Terms of Use by using the reporting function available on the Website or by writing to service.customers@travellersocks.com.
The notification must include sufficient information to identify the disputed content and assess its unlawful nature.
Article 8 - Publisher's Liability
8.1 Website Content
The Publisher endeavours to provide accurate and current information on the Website concerning the products offered, including their descriptions, characteristics and prices.
However, the Publisher cannot rule out clerical errors or delayed updates. Product photographs are not contractually binding; only the characteristics stated on the product pages and in the applicable Terms and Conditions of Sale are contractually binding.
8.2 Hyperlinks
The Website may contain hyperlinks to other websites or external sources. These links are provided for information purposes only.
The Publisher has no control over such websites and shall not be liable for their content, advertisements, products, services or any other information or data available on or from them.
8.3 Limitation of Liability
Subject to the mandatory provisions applicable to Consumers, the Publisher shall be liable only for direct and foreseeable losses resulting from a proven breach of its obligations under these Terms of Use.
Under no circumstances shall the Publisher be liable for:
• indirect losses, such as loss of turnover, loss of customers, loss of opportunity or damage to reputation;
• loss or damage resulting from the User's improper use of the Website;
• loss or damage resulting from the User's breach of their own obligations or of applicable regulations.
Article 9 - Intellectual Property
9.1 Website Content
All elements of the Website, including text, images, photographs, illustrations, logos, trademarks and domain names, are protected by intellectual property rights. They are the exclusive property of the Publisher or of its partners, which have granted the Publisher the rights required for their use in connection with the operation of the Website. Any reproduction, representation, modification, adaptation, translation, extraction, reuse, distribution or exploitation, in whole or in part, of the Website or any of its elements, on any medium and by any process, without the Publisher's prior written permission, is strictly prohibited and may constitute infringement.
9.2 Limited Licence to Use
The Publisher grants the User a personal, non-exclusive, non-assignable and non-transferable right to access and use the Website and its content for the User's own purposes, in strict compliance with these Terms of Use.
This right of use does not transfer any intellectual property right to the User.
9.3 Content Provided by Users
By publishing content on the Website, such as a review, comment or photograph, the User grants the Publisher, free of charge, a non-exclusive, worldwide licence for the legal term of the applicable intellectual property rights, allowing the Publisher to reproduce, represent, adapt, translate and distribute that content on the Website and on any communication medium related to the promotion of the products, subject to respect for the User's moral rights.
The User warrants to the Publisher that they hold all rights required in relation to the content they upload and that such content does not infringe any third-party rights.
Article 10 - Personal Data and Cookies
10.1 Personal Data
The Publisher states and undertakes that it complies with the personal data regulations applicable in France, including Regulation (EU) 2016/679 of 27 April 2016, known as the General Data Protection Regulation (GDPR), and the amended French Data Protection Act of 6 January 1978.
Detailed information on data processing, retention periods and the exercise of rights is provided in the Website's Privacy Policy, to which these Terms of Use expressly refer.
10.2 Cookies and Trackers
The Website may use cookies and other trackers to improve the browsing experience, measure audience levels, personalise content and, where applicable, provide targeted advertising.
Detailed rules concerning the use of cookies, the period for which choices are retained and the methods for withdrawing consent are set out in the Website's Cookie Policy, to which these Terms of Use expressly refer.
Article 11 - Governing Law and Jurisdiction
11.1 Governing Law
These Terms of Use are governed by French law.
French law applies subject to any more protective mandatory provisions that may apply to the Consumer pursuant to Regulation (EC) No. 593/2008 of 17 June 2008, known as the Rome I Regulation.
11.2 Amicable Settlement of Disputes
In the event of a dispute relating to the interpretation, validity or performance of these Terms of Use or to the use of the Website, the User and the Publisher shall endeavour to reach an amicable solution before commencing legal proceedings.
11.3 Jurisdiction
For disputes involving a Consumer, the mandatory territorial jurisdiction rules set out in the French Consumer Code and the French Code of Civil Procedure apply. The Consumer may, at their choice, bring proceedings before any court having territorial jurisdiction under the general rules or before the court for the place where the Consumer resided when the contract was entered into or when the harmful event occurred.
Article 12 - Miscellaneous Provisions
If one or more provisions of these Terms of Use are held to be invalid or declared invalid pursuant to a law or regulation or following a final decision of a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
The Publisher's failure, at any time, to rely on any provision of these Terms of Use shall not be construed as a waiver of its right to rely on that provision at a later date.
